On September 24, 2009 the trial of late soldier Andranik Hayrapetyan took place at the Appellate Court of Armenia. The judge did not allow M. Danielyan, the assignee representative to express his opinion reasoning that M. Danielyan did not have power of attorney for an assignee representative, though there is a power of attorney given by A. Kirakosyan and ratified by the notary in the materials of a criminal case, as well as there is a decision of an investigator which says that M. Danielyan and A Babayan are as assignee’s representatives, and finally it is registered in the conviction given by the Court of First Instance of Shengavit district, Yerevan.

On 07 July 2007 Hovhannes Meltonyan, a soldier performing his compulsory military service in No. 27229 military unit of the Defense Ministry of Armenia, was killed. According to an official version, unable to endure beatings and scoffing by his co-servicemen, he entered the armory-room of the company shot himself by the machine-gun assigned to him.

On 10 August 2005 at 06:45 the corpse of Private Robert Hovhannisyan, an Armenian national, was found in one of the military posts of the artillery battalion belonging to the No. 36534 military unit of the Defense Ministry of Armenia (Nagorno-Karabakh Republic), with firearm wound in the head. According to the medical examiner’s report, the corpse bore many traces of torture. A. Krkyasharyan, an investigator to the case, brought charges against several persons by adopting the version of suicide. However, unable to reason his false approach to the incident, he suspended the case due to the impossibility to find those who committed the crime.

According to an official version, on 15 April at 9:00 p.m. Henrik Grigoryan, a duty officer at No. 37673 military unit of the Armenian Defense Ministry, noticed Private Gegham Sergoyan in slippers and without wearing a hat. First H. Grigoryan made a remark to the private soldier, then he insulted him and right after took out prescribed to him “Makarov”-type pistol and shot G. Sergoyan to the head wounding his heavily. The latter died in hospital 15 days after. A criminal case No. 90001107 was opened into the death.

According to the papers presented by the prosecution office, on 07 July 2007 at 6:30 a.m. Garik Mikayelyan, an Armenian national, who was performing compulsory military service as Liaison Platoon Commander at No.75937 military unit located in Nagorno-Karabakh Republic, suffered a power shock from a power supply station located in the military unit. He received third-degree burns of the upper extremities and as a result had both his arms amputated. A criminal case No. 90603507 was opened into the incident led by investigator Gnel Manukyan.

According to an official version of the military prosecution office, on 06 June 2007 Eduard Mirzoyan, a soldier performing compulsory military service in No. 49971 military unit of the Defense Ministry of Armenia (Republic of Nagorno Karabakh), died 15 minutes after being wounded in the region of the heart as a result of enemy fire. Considering these “facts” as well-grounded, A. Mirzoyan, an investigation to the case, brought a charge against Igor Atanyan, Deputy Battalion Commander on Personnel for “duty abuse resulting in aggravated consequences” as provided in Paragraph 2 of Article 275 of CC of Armenia. A criminal case No. 90803507 was opened into the death.

Arsen Simonyan, an Armenian national who was performing his military service in N.36534 military unit of the Defense Ministry of Armenia (Republic of Nagorno Karabakh) died on 7 July 2005. Officials state that he committed suicide. Investigation says A. Simonyan’s “suicide” was prompted by constant abuses he was subjected to by his co-servicemen, namely Junior Sergeant M. Mkhitaryan and Sergeant G. Barseghyan.

Since 1994, when the cease-fire was established between the armies of Nagorno Karabakh and Azerbaijan, an uncertain, legally complicated and confusing situation was formed in Nagorno Karabakh. The status of the soldiers of RA, who were trying to help their compatriots from Armenia, could, in no case, be settled. That is, being the citizens of a given country, they factually serve in the army of another country and were subjected to the laws of that very country: Nagorno Karabakh.

Khachatur Meliqyan, an Armenian national who was a soldier of military unit No 46492 based in Stepanakert (Nagorno Karabakh Republic) was murdered on 15 March 2005. An investigator of Garrison Prosecutor’s Office of Askeran of military prosecutor’s office of RA “has found out” that it was a careless manslaughter. According to the investigation results, S. Dilanyan was at watch at one of the observation points of the military post No.145 when M. Dumikyan, his co-duty soldier, visited him at his observation point, something that he was not allowed to do at that time. M. Dumikyan ordered S. Dilanyan to give him AK gun which belonged to S. Dilanyan. Having taken the gun he made three single shots and one burst. As a result he unintentionally killed Kh. Meliqyan, a soldier who was at watch in the neighboring observation point.
